1. General Provisions
1.1. Welcome to the Distinguish Me online store, where we offer handmade accessories for dogs and other products for pets (hereinafter – Products). These purchase terms and conditions (hereinafter – Rules) determine the rights, obligations, and responsibilities of the person purchasing the products in the online store www.distinguishme.eu (hereinafter – Buyer) and the person manufacturing and selling the products (hereinafter – Seller), as well as the procedures for delivery and return of products and other provisions related to the purchase and sale of products. By using our website and/or placing an order, you agree to these Rules.
2. Conclusion of the Purchase and Sale Agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment the Buyer, having formed a shopping cart in the online store, provided information about themselves, selected a payment method, and familiarized themselves with these Rules, pays the required amount for the purchased products, and remains valid until full performance of obligations under this agreement. If the Buyer does not agree with all or part of the Rules, they must not place an order.
3. Seller’s Rights
3.1. The Seller has the right to unilaterally change these Rules by posting them on the online store website. Changes take effect from the moment of publication for all transactions concluded after the publication.
3.2. In important circumstances, the Seller may temporarily or completely suspend the operation of the online store, providing prior notice to the Buyer.
3.3. The Seller has other rights specified in the Rules and the legal acts of the Republic of Lithuania.
4. Seller’s Obligations
4.1. The Seller commits to respect the Buyer's privacy.
4.2. The Seller undertakes to make efforts to allow the Buyer to properly use the services provided by the online store. The Seller does not guarantee uninterrupted operation of the online store or error-free data transmission. The Seller is not responsible for any losses incurred by the Buyer related to the operation disruptions of the online store and/or data transmission errors.
4.3. If unable to fulfil the order, the Seller commits to promptly inform the Buyer and immediately refund the money paid if the payment was already made.
4.4. In important circumstances, if unable to deliver the ordered product to the Buyer, the Seller commits to offer a similar product, and if the Buyer refuses to accept the substitute product, to refund the money paid by the Buyer within 10 business days. In this case, the Seller is released from liability for not delivering the products.
4.5. The Seller commits to dispatch the ordered products to the Buyer within 2 - 4 business days from payment for the products.
4.6. The Seller commits to replace and/or fix any discrepancy and/or defect in the product that occurred due to our fault.
5. Buyer’s Rights
5.1. The Buyer has the right to purchase products in the online store in accordance with these Rules and the legal acts of the Republic of Lithuania.
5.2. The Buyer (consumer) has the right to withdraw from the product purchase and sale agreement concluded in the online store with the Seller by notifying the Seller in writing (info@distinguishme.eu) within 14 business days from the date of product delivery, provided that the product was not made according to individual order. The Buyer has the right to withdraw from the product purchase and sale agreement with the Seller only if the product is of good quality, undamaged, and its appearance has not fundamentally changed. The Civil Code sets the term for returning defective products, within which the Buyer can make claims regarding product defects.
5.3. The Buyer has other rights specified in the Rules and the legal acts of the Republic of Lithuania.
6. Buyer’s Obligations
6.1. The Buyer must pay for the products and their delivery, as well as other payments (if specified when concluding the agreement) and accept the ordered products. The Buyer pays for the products using the payment methods specified in the www.distinguishme.eu store.
6.2. The Buyer undertakes to provide accurate information in the order form: name, surname, delivery address, and phone number. If the Buyer provides inaccurate, false, or misleading data, the Seller has the right to cancel the Buyer’s order. If products are returned due to the Buyer’s fault, the money for the purchased products is refunded without delivery costs and only at the Buyer’s request.
6.3. If the Buyer’s details provided to the Seller change, the Buyer must immediately notify the Seller.
6.4. The Buyer must confirm the payment order in their internet bank, where a link is provided from the online store (if the Seller has an appropriate agreement with the Buyer’s bank). The Buyer’s selected products are reserved and the Seller starts executing the purchase and sale agreement only when the Seller receives a notification from the Buyer’s bank about the payment made for the selected products.
6.5. The Buyer must accept the products themselves. If the Buyer cannot accept the products personally and the products are delivered to the specified address, the Buyer has no right to make claims to the Seller regarding delivery to the wrong recipient.
6.6. The Buyer must comply with other Rules and the requirements established by the legal acts of the Republic of Lithuania.
7. General Liability
7.1. The parties are liable for the violation of the purchase and sale agreement concluded using the online store in accordance with the legal acts of the Republic of Lithuania.
7.2. The Seller is not responsible for the fact that the products displayed in the online store do not match the actual size, shape, and colour of the products due to the characteristics of the Buyer’s display.
7.3. According to the provisions of Article 8(3) of the Law on Electronic Signatures of the Republic of Lithuania, the Buyer agrees with the Seller that the confirmation of the Buyer’s actions in the online store by logging in with the Buyer’s identification code has the legal force of an electronic signature as established in Article 8(1) of the Law on Electronic Signatures (i.e., has the same legal force as a signature on written documents and is admissible as evidence in court). The Buyer must keep their login details to the online store confidential and ensure that the data is known only to them and used only by them, not to disclose and not to make the data available to others. If there is a suspicion that the login data might have been known by another person, immediately notify the Seller and also immediately inform the Seller about the breach or disclosure of the login data. All actions performed using the Buyer’s identification code are considered to be performed by the Buyer, and the Buyer assumes full responsibility for the consequences of such actions.
8. Processing of Personal Data
8.1. By clicking the “Pay” button, the Buyer confirms that they and their representatives (the Buyer has the consent of their representatives) agree to provide their personal data to the Seller and do not object to the processing of the personal data provided by the Buyer and/or their representatives by the Seller for the purposes of identification, contract conclusion, execution (online trading), and direct marketing. The Seller indicates that the personal identification codes of the Buyer (if the Buyer is a natural person) and their representatives will not be processed by the Seller for direct marketing purposes.
8.2. Both registered and unregistered members will receive the newsletter by clicking the “Subscribe to newsletter” button, after which the customer will automatically start receiving newsletters, which they can unsubscribe from by clicking the link at the bottom of the newsletter. The Seller sends all informational messages to the email address provided in the Buyer’s order form.
8.3. The Buyer sends all notices and questions to the Seller using the contact details provided on the Seller’s online store: info@distinguishme.eu, Facebook Messenger to the Distinguish Me account.
8.4. By clicking the “Pay” button, the Buyer confirms that they (if the Buyer is a natural person) and their representatives are informed about their right to access their personal data processed by the Seller and how it is processed, to request correction, destruction of their personal data, or suspension of their personal data processing when the data is processed in violation of the law, and to object to the processing of their personal data.
8.5. By clicking the “Pay” button, the Buyer confirms that they and their representatives know they have the right to refuse to provide their personal data, but understand that personal data is necessary and required to unambiguously identify the Buyer and/or their representatives for the purposes of contract conclusion and execution (online trading), and without providing personal data and/or refusing to process it for the above-mentioned purposes, they will not be able to conclude and/or execute the contract.
9. Final Provisions
9.1. The Buyer and the Seller agree that all information provided on the Seller’s online store website (including, but not limited to, these Rules, information about the Seller, offered products and services, their characteristics, the Buyer’s right to withdraw from the purchase and sale agreement, product maintenance services provided by the Seller and warranties (if any)) is considered provided to the Buyer in writing.
9.2. All disputes arising or related to the purchase and sale agreement between the Buyer and the Seller are resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the legal acts of the Republic of Lithuania.
